How Long Do I Have to File a Car Accident Claim in Florida?
According to section 95.11(3)(a) of the Florida Statute of Limitations, you have up to four years to file a claim for a car accident.
However, it’s better that you don’t delay or wait the full four years to file your car accident claim. Filing as soon as possible ensures that your memory, as well as the memories of witnesses to your accident, will be detailed and accurate when providing testimonies to strengthen your case. Additionally, in some cases, it can be beneficial to recreate the scene of the accident in order to prove fault—and this is easier to do the more recent the accident was.
Common Car Accident Injuries
If you’re involved in a car accident, you could very likely suffer from a range of injuries. These injuries can happen to practically any part of your body due to the nature of a car accident. Some common injuries include:
- Brain injuries
- Back/spinal cord injuries
- Internal damage
- Broken/fractured bones
- Loss of limbs
How RAK Law Can Help
There are several ways our Florida car accident lawyers can help you with your case.
We will get to know you on a personal level and learn every facet of your case. We know our clients on a first-name basis. When you schedule an initial consultation with us, we’ll get to know as much as possible about your car accident and how you’re suffering because of it. Using our years of experience and knowledge of personal injury and traffic laws in Florida, we’ll educate you regarding your legal options.
We will guide you in gathering the documentation necessary for your case. When it comes to a car accident, there’s a lot to keep track of—and this is especially daunting when you’re not feeling well. We’ll let you know exactly what information we need, such as police reports and photos from the accident scene, documents relating to the accident that you filed with your insurance company, receipts of medical treatment you received after the accident, and a log of any work hours or compensation you missed due to the accident.
We work to prove that the other party is at fault. Florida is a “no-fault” state when it comes to car collisions—in other words, both parties involved in the collision can file claims with their respective insurance companies, no matter who caused the crash. However, this does not mean there’s no way to prove the other party was at fault for the crash and your injuries.
We are a civil litigation firm, which means we don’t back down when a case requires time and careful consideration at trial. We’ll record a detailed account from you and any witnesses who were present at the scene of the crash, analyze photos of damages to your vehicle, refer you to our trusted network of medical professionals to prove the extent of any injuries you may have incurred from the accident, and determine which traffic laws the other party violated when they crashed into your vehicle.
